6.1. Departure for permanent residence abroad
           
Conditions and procedure for the departure of citizens of the Republic of Kazakhstan outside the country
(Article 55 of the Law of the Republic of Kazakhstan “On Migration of the Population”).
1. Everyone has the right to travel outside the Republic of Kazakhstan. Citizens of the Republic of Kazakhstan have the right to unimpeded return to the Republic of Kazakhstan.
2. Departure to a permanent place of residence from the Republic of Kazakhstan is carried out after the execution of documents for departure by the bodies of internal affairs.
3. Applications for leaving the Republic of Kazakhstan for permanent residence are submitted to the internal affairs bodies:
1) capable citizens – personally;
2) on behalf of children and citizens recognized by the court as legally incompetent, their legal representatives.
4. The bodies of internal affairs shall verify the absence of grounds for refusing to leave the territory of the Republic of Kazakhstan for citizens who applied for travel outside the Republic of Kazakhstan to a permanent place of residence.
Inquiries of the internal affairs bodies regarding citizens who applied for travel to the permanent place of residence outside the Republic of Kazakhstan are considered by the interested state bodies within ten days.
The decision to issue travel documents outside the Republic of Kazakhstan for permanent residence is taken no later than a month from the date of submission by the applicant of all documents in the manner determined by the Government of the Republic of Kazakhstan.
5. Financing of costs associated with the departure from Kazakhstan of citizens of the Republic of Kazakhstan for permanent residence in other states is carried out at the expense of the own funds of the departing, and can also be carried out from other sources, if this does not contradict the legislation of the Republic of Kazakhstan.
6. Citizens of the Republic of Kazakhstan who leave the Republic of Kazakhstan for permanent residence in other countries are entitled to export at their own expense property belonging to them and their family members in accordance with the legislation of the Republic of Kazakhstan.
7. Export of objects representing cultural, historical or other value to the state outside the Republic of Kazakhstan is regulated by the procedure established by the legislation of the Republic of Kazakhstan.
8. The rights of persons who left the Republic of Kazakhstan for permanent residence in other states, for property located on the territory of the Republic of Kazakhstan, are determined by the legislation of the Republic of Kazakhstan.
 
In accordance with Article 56 of the Law of the Republic of Kazakhstan “On Migration of the Population”, a citizen of the Republic of Kazakhstan may be refused in accordance with the legislation to leave the Republic of Kazakhstan in cases if he:
1) possess information constituting a state secret and other secret protected by law, and has not notified the relevant authorized bodies about the fact of his departure from the Republic of Kazakhstan – before the termination of these circumstances;
2) detained on suspicion of committing a crime or brought in as an accused – before making a decision on the case or entering into legal force of the court verdict;
3) convicted for the commission of a crime – until the serving of punishment or release from punishment;
4) refuses to fulfill the obligations entrusted to him by the court – until the termination of these obligations;
5) undergo active military service – until the completion of the service or until it is released from it in accordance with the Law of the Republic of Kazakhstan “On Military Duty and Military Service”;
6) reported deliberately false information about himself when processing documents for departure from the Republic of Kazakhstan – until the reasons that served as grounds for refusing and submitting reliable information were eliminated;
7) is the defendant in civil proceedings – before the entry into force of a court decision.
A citizen of the Republic of Kazakhstan refuses to leave his place of permanent residence outside the Republic of Kazakhstan if he has a tax debt.
In all cases of restriction of the right to leave the Republic of Kazakhstan for permanent residence, the authorized body for migration issues issues a notification to the citizen of the Republic of Kazakhstan stating the grounds and terms of the restriction and the procedure for appealing against this decision.
Departure for permanent residence from the Republic of Kazakhstan is carried out by permission of the internal affairs bodies.
When traveling outside the Republic of Kazakhstan with other purposes (for business, private affairs, as tourists, for work, study, treatment, rest), the permission of the internal affairs bodies is not required. Data of children under 16 years old who are temporarily traveling outside the Republic of Kazakhstan can be entered in the passports of parents (guardians, trustees). Recording is done in Latin letters. In this case, photos of children older than three years are pasted into the passport.
Children traveling without parents (guardians, trustees) with accompanying persons are issued passports of a citizen of the Republic of Kazakhstan.
